Labour Market Impact Assessment (LMIA)

If you have a job offer in Canada and wish to apply for a work permit, the LMIA (Labour Market Impact Assessment) process may be the best option. However, both foreign workers and Canadian employers should be aware that the LMIA process is not simple.

The LMIA process in Canada demonstrates that no Canadian citizen or permanent resident is ready, willing, or able to fill a given post in Canada, allowing the business to engage a foreign worker. Employers must advertise the position for at least four weeks and potentially interview candidates who are Canadian citizens or permanent residents in order to receive an LMIA.

Only then, and only if the company can show that the interviewees did not meet the job requirements, will the company be allowed to hire a foreign worker. Before starting work in Canada, the worker must apply for a Canadian work permit, which will be sponsored by the LMIA.

LMIA applications are complex and necessitate a great deal of paperwork and statistical analysis. A numerical breakdown of the number of Canadian candidates for the post, the number of job offers given, and the number of unqualified applicants are just a few examples. Employers must submit a written explanation as to why each Canadian who was not hired was unqualified for the position. Work permit streams that are LMIA-exempt fall under the International Mobility Program, which does not require the issuance of an LMIA for all types of work permits.
