Detention Review
If the CBSA has reasonable grounds to suspect that a foreign national or permanent resident is unlikely to attend for an examination, hearing, or removal, or is a threat to the public, the individual may be detained or held. If it has reasonable grounds to believe that the person is inadmissible to Canada – that is, not allowed to enter or remain in the country – for security concerns, or for violating human or international rights, serious criminality, criminality, or organized criminality.
Foreign nationals and permanent residents detained by the Canada Border Services Agency (CBSA) for immigration grounds must first appear before the CBSA and then the Immigration Division (ID) of the Immigration and Refugee Board of Canada for detention reviews (IRB).
