Caregiver Pathway to PR

If they provide at-home care for children, seniors, or individuals with disabilities, foreign nationals in Canada can apply for permanent residency through the Caregiver programme.

In this programme, the caregiver lives with the care receiver in accordance with their mutual agreement. The employer additionally files a Labour Market Impact Assessment (LMIA) with IRCC and does not deduct any boarding and lodging costs from the caregiver’s pay.

Eligibility for Permanent Residence in Canada as a Live-in Caregiver

✓ An LCP work permit holder who is a foreign national caregiver is eligible to apply.

✓ A foreign national caregiver who has agreed to and written the live-in arrangement in the LMIA can apply.

Caregiver can apply for permanent residency in three different ways in this program :

Childcare — a foreign national caregiver with at least two years of full-time child care experience in a Canadian home is eligible to apply.

People with significant medical needs – a foreign national caregiver with at least two years of experience working in Canada as a home support worker, nurse, or nursing aide may apply.

Foreign national caregivers with at least two years of work experience in Canada’s live – in caregiver programme are eligible to apply.

Criteria for Employer Eligibility

✓ The employer has been unable to find a suitable Canadian citizen or permanent resident to fill the available position of caregiver.

✓ Employer with sufficient financial resources to pay the caregiver’s salary

✓ The employer has a requirement that the caregiver remain in their home, therefore they make them a work offer to care for a disabled person, a senior, or a child.

Criteria for Caregivers’ Eligibility

✓ Should be a part of the Live-in Caregiver Program

✓ The live-in working arrangement must be maintained.

The Program’s Application Process

After the caregiver has been shortlisted, the following actions will be taken by the employer as and when they are due:

✓  Submit an LMIA application.

✓  Make an application for a new work permit for the carer.

✓  Make changes to the LMIA application to reflect the live-in arrangement.
